The first one is Duty, which is establishing that the opposing party had the duty of taking care of the affected individual. This Duty is established simply by being a member of society. For example, when you’re driving, you have the Duty to everyone else on the road to keep them safe and not harm them.

The second factor that must be present is a Breach of Duty. This means that an established Duty has been breached by another individual. The At-Fault party is the individual or individuals who breach their duty of care. For example, if an individual isn’t driving carefully and hits someone else on the road, that reckless driver has breached their duty of care and is the At-Fault party.

The third factor is called Causation, meaning that there’s a link between the At-Fault party and the injury that was sustained by the victim. This essentially means that the Breach of Duty is what directly caused the injury in question. In the driving scenario, if the individual who breached their duty hit your car and you are injured as a result, then the causation is directly related to their actions.

The last factor is Damages, meaning that there must be some sort of damage ensuing from the injury. This could be any sort of physical damage to your person as a result of another individual’s Breach of Duty, such as a broken bone, dislocated knee, herniated disk, or any other injury.

Physical injuries are not the only types of injury that are accounted for in this situation – there are also monetary damages. These may include any costs you have to pay as a result of the injury you sustained.
