What To Do Before You File For Divorce

Published on December 27th, 2019

Filing for divorce can be one of the most difficult things a person has to do in their lifetime. The process of filing is tedious, time consuming, and emotionally draining.

At Crosby Law we try to make this difficult experience as easy as possible for everyone involved. When you hire us to represent you, you will not only get a great divorce lawyer based in Rockford, Illinois, but a firm that cares about yours and your family’s well-being. Below is a list of things you should do before filing for divorce.

  1. Be absolutely certain of your decision. Divorce papers should not be served during an emotional period when tempers are running high. Undergo marriage counseling if feasible, and do your very best to reconcile before making a final decision.
  2. Collect all financial records such as mortgage documents, banking information, and other histories of expenses.
  3. If you and your spouse have children together, determine what your goals are for custody.
  4. Make any large sales or purchases before filing for divorce. Most often, it is illegal to make significant purchases or sales once you begin your divorce proceedings, or otherwise dispose of materials which could have significant value in the case.
  5. Decide on where you will be living once the divorce proceedings begin.
  6. If you and your spouse have joint accounts or share a credit card, it may be wise to ask an attorney for advice on whether you should change this before filing for divorce.
  7. Make a list of all your debts and assets so you have a better idea of what you want monetarily from the divorce.
  8. Refrain from acting as if you are no longer married before the divorce is final, i.e. dating other people.
  9. Find a group you can lean on for support during this difficult time.
  10. Finally, find the right attorney who is qualified to handle your case and every matter related to finances, family custody, and other things than can make a divorce messy. If your divorce is going to be anything but simple, you need a firm like Crosby Law that is reliable, experienced, and willing to fight for you.
